House Phase Construction LLC d/b/a Blackstone Custom Homes is a licensed custom home builder operating in Upstate South Carolina, including Spartanburg, Greenville, and surrounding counties. Our services include, but are not limited to:

- Custom home design consultation and planning

- New home construction and project management

- Permitting, inspections, and code compliance coordination

- Subcontractor and materials sourcing and oversight

- Client communication and progress reporting throughout the build

All services are subject to a separate written construction agreement or contract executed between House Phase Construction LLC d/b/a Blackstone Custom Homes and the client. These Terms do not replace or supersede any signed contract.

2. Website Use

You may use our website for lawful purposes only. You agree not to:

Any changes to the agreed project scope, materials, or timeline must be documented through a written change order signed by both parties before work begins. Verbal agreements to change the scope of work are not binding. Change orders may affect the project price and schedule, and House Phase Construction LLC d/b/a Blackstone Custom Homes will not be responsible for delays or costs resulting from unapproved scope changes.

5. Payment Terms

Payment schedules and terms are outlined in the signed construction agreement. General expectations include:

- A deposit is required before project commencement

- Draw payments are made at agreed-upon project milestones

- Final payment is due upon substantial completion and prior to final walkthrough

- Invoices not paid within the specified period may be subject to late fees as outlined in the contract

House Phase Construction LLC d/b/a Blackstone Custom Homes reserves the right to suspend work on a project if payments are not received according to the agreed schedule.

6. Warranties

Workmanship Warranty

House Phase Construction LLC d/b/a Blackstone Custom Homes warrants that all work will be completed in a professional and workmanlike manner in accordance with applicable building codes and industry standards. Specific warranty terms and durations are outlined in the construction agreement.

Manufacturer Warranties

Materials, fixtures, appliances, and equipment installed in your home may carry separate manufacturer warranties. We will provide all applicable warranty documentation at project completion. Manufacturer warranties are subject to their own terms and conditions.

Exclusions

Warranties do not cover damage resulting from:

-Client misuse, neglect, or failure to maintain the property

- Modifications made by the client or unauthorized third parties after completion

- Acts of God, natural disasters, or extreme weather events

- Normal wear and tear

7. Client Responsibilities

To ensure the smooth progress of your project, clients agree to:

- Make timely decisions on design selections, materials, and finishes within agreed deadlines

- Provide site access to House Phase Construction LLC d/b/a Blackstone Custom Homes, subcontractors, and inspectors as needed

- Communicate all concerns or requests in writing through designated channels

- Make payments according to the schedule outlined in the construction agreement

- Obtain any HOA or community approvals required prior to construction

Delays caused by the client's failure to meet these responsibilities may affect the project timeline and could result in additional costs.

8. Delays and Force Majeure

House Phase Construction LLC d/b/a Blackstone Custom Homes will make reasonable efforts to complete your project on schedule. However, we are not liable for delays caused by circumstances beyond our reasonable control, including but not limited to:

- Weather events or natural disasters

- Supply chain disruptions or material shortages

- Permitting or inspection delays by government authorities

- Labor shortages or subcontractor unavailability

- Acts of God, pandemics, or other force majeure events

In such events, we will notify you promptly and work with you to revise the project schedule as needed.

9. Limitation of Liability

To the fullest extent permitted by law, House Phase Construction LLC d/b/a Blackstone Custom Homes shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from our services shall not exceed the total amount paid by you to House Phase Construction LLC d/b/a Blackstone Custom Homes for the specific project giving rise to the claim.

10. Dispute Resolution

Good Faith Resolution

In the event of a dispute, the parties agree to first attempt to resolve the matter through good-faith negotiation. Either party may initiate this process by providing written notice describing the dispute in reasonable detail.

Mediation and Arbitration

If good-faith negotiation fails to resolve the dispute within thirty (30) days of written notice, the parties agree to pursue mediation or binding arbitration in Spartanburg County, South Carolina, before pursuing litigation. The costs of mediation or arbitration shall be shared equally unless otherwise determined by the arbitrator.

Governing Law

These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to conflict of law principles.

11. Third-Party Links and References

Our website may reference or link to third-party websites, suppliers, or resources for your convenience.
